If you do refer a friend to be into win a Luxury Two Night Escape Competition, you agree to be bound by the Cape Kidnappers/ Landrover and Hushaberry terms and conditions.
The Luxury Two Night Escape draw will be held at the end of the competition after the Main Prize has been announced in July and the close date on 30 June 2019.
1. The Promoter
The promoter of this promotion is: Hushaberry Limited trading as Hushaberry, CP Wool, 1194 Maraekakaho Road, Hastings..
2. The Draw
2.1 If 500,000 entries must be in the for the Luxury Two Night Escape Competition by 1st July 2019 a draw to win Two nights at The Farm at Cape Kidnappers, a Landrover for two days and a Hushaberry winter warmer (Wool throw and woolly bean bag from the Hushaberry range. will be held (the “Hushaberry Draw”).
2.2 These terms and conditions apply to anyone entering the Luxury Two Night Escape Draw. Where there are any terms or conditions in the Hushaberry Draw terms and conditions that contradict any terms and conditions from the Luxury Two Night Escape Competition terms and conditions (the “Main Competition”) listed on the Promoter’s website at www.hushaberry.com, the Main Competition terms and conditions will supersede the terms and conditions in this document. Any terms or words not specifically defined in the “Main Competition" terms and conditions will have the meaning of the terms or words so defined in the Main Competition terms and conditions.
2.2 The Luxury Two Night Escape Draw is free to enter. There is no payment method available.
2.3 The Luxury Two Night Escape Draw will be held at the same time as the Draw for the Main Competition, by 30 June 2019 (the “Cut-off Date”).
2.5 The Promoter, at its absolute discretion, may extend the Cut-off Date. The Cut-off Date may not be extended beyond the Closing Date of the Main Competition.
2.4 Everyone who enters the Main Competition (an “Entrant”) may enter the email address of the person who referred them (the “Referrer”) in the referral code box on the submission form for the Main Competition. If the email address of the Referrer is entered in the referral code box, both the Referrer and the Entrant will receive one entry into the Luxury Two Night Escape Draw.
2.5 There is no limit on the number of times a Referrer or Entrant may enter the Luxury Two Night Escape Draw.
2.6 An entry into the Luxury Two Night Escape Draw will only be valid if a valid email address is entered in the referral code box on the Main Competition entry form.
2.7 Winners will be selected at random by using a random number generator. Each valid entry to the Luxury Two Night Escape Draw will be listed in chronological order in an excel spreadsheet and the number generated by the random number generator will correlate to the row number in excel of the winner. The winner will be selected once.
3 The Prizes
3.1 The winner of the Luxury Two Night Escape Draw will win Two nights at The Farm at Cape Kidnappers, a Landrover for two days and a Hushaberry winter warmer (Wool throw and woolly bean bag from the Hushaberry range.
3.2 The winner must collect the Landrover from the Napier airport, (flights are not included). Failure to do so within 1 July – 30 November 2019, the will result in the prize being withdrawn. The prize is non transferrable and can not be redeemed for cash.
Accommodation is subject to availability and not redeemable over special event weekends or public holidays.
3.3 All costs including but not limited to road tax, insurance, collection and transport are specifically excluded from the prize and will be paid for by the winner.
4. Eligibility
4.1 The Luxury Two Night Escape Draw is only open to all residents in NEW ZEALAND and any other jurisdiction where no local laws are contravened, and aged 18 years or over, except:
(a) employees of the Promoter;
(b) employees of agents or suppliers of the Promoter or its holding or subsidiary companies, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 By entering the Luxury Two Night Escape Draw, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Luxury Two Night Escape Draw. If you fail to provide the Promoter with any such proof or other information that they may require within a reasonable time, you may be disqualified from the draw.
4.3 The Promoter will not accept entries that are: (a) automatically generated by computer; or (b) incomplete.
4.4 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Luxury Two Night Escape Draw.
4.5 There is no cash value to being entitled to enter the Luxury Two Night Escape Draw
4.6 If the Main Competition is cancelled for any reason, there will be no Luxury Two Night Escape Draw.
4.7 In the event of a dispute regarding the identity of the individual submitting an Entry Form, the entry will be deemed to be submitted by the individual in whose name the e-mail account stated on the Entry Form is registered on the date the Entry Form is submitted.
4.8 In the event of a dispute regarding the identity of the individual named in the referral code box on the Entry Form, the referral will be deemed to belong to the individual in whose name the e-mail account stated on the Entry Form is registered on the date the Entry Form is submitted.
4.9 By entering an email address in the referral code box you agree not to take part in any class action law suit against the Promoter.
4.10 By asking for your email address to be entered in the referral code box and another Entrants Entry you agree that you want to be included in the Luxury Two Night Escape Draw and not to take part in any class action law suit against the Promoter.
5. Winners
5.1 The decision of the Promoter is final and no correspondence or discussion will be entered into.
5.2 The Promoter will make all reasonable efforts to contact the winner as soon as practicable after the Draw Date, using the telephone number or email address provided with their competition entry.
If the winner cannot be contacted or is not available, or has not claimed the PRIZE within 21 days of the Draw Date, the Promoter reserves the right to offer that prize to first runner up selected at the time of the Luxury Two Night Escape Draw.
5.3 The Promoter will send the initial and last name of the winner(s), should the winner(s) give their permission for such details to be given, to anyone who writes within one month after the Closing Date of the Main Competition requesting details of the winner and who encloses a self-addressed envelope to the address set out in condition 1.
6. Claiming the Luxury Two Night Escape
6.1 The winner must claim the Luxury Two Night Escape personally. The Luxury Two Night Escape may not be claimed by a third party on your behalf.
6.2 If your personal details, including contact information, changes at any time you should notify the Promoter as soon as reasonably possible. Notifications should be sent to the Promoter by completing the “Update your contact details” form on the “contact us” page on the Main Competition website. If your details change within 10 days of the Closing Date, the Promoter will use your old details if it needs to try to contact you.
6.3 No cash alternative will be offered for THE Luxury Two Night Escape.
6.4 The Promoter does not accept any responsibility and is not liable to pay any compensation if you are unable to or do not take up the Luxury Two Night Escape.
7. Limitation of liability
Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Luxury Two Night Escape except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
8. Data protection and publicity
8.1 If you are the winner of any of the prizes of the Luxury Two Night Escape Draw, you agree that the Promoter may use your name, image and town of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.
8.2 If you are the winner of any of the prizes of the Luxury Two Night Escape Draw, you further agree to participate in any reasonable publicity required by the Promoter such as providing a comment about how you felt to receive the prize and a photograph of you celebrating.
8.3 If you are the winner of the Luxury Two Night Escape, you may be required to provide further personal information and proof of your identity in order to confirm your eligibility to claim the Luxury Two Night Escape PRIZE. You consent to the use of your information in this way. You are entitled to request further details about how your personal information is being used. You may also withdraw your consent to your personal information being used in such way but by doing so you may prevent the Luxury Two Night Escape being transferred to you. In such circumstances, you will be deemed to have withdrawn from the Luxury Two Night Escape Draw and forfeit the Luxury Two Night Escape prize. You will not be entitled to any refund of your entry to the Main Competition or any compensation. The Promoter reserves the right to offer the Luxury Two Night Escape to the first runner up drawn in the Luxury Two Night Escape Draw.
8.4 By entering the Main Competition and also entering an email address in the referral code box on the Entry, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter or its agents and suppliers to administer the competition or as otherwise set out in the Promoter’s Privacy Policy, a copy of which is available on the Website.
8.5 Please note that under data protection laws you are entitled to request that the Promoter does not contact you and removes your details from its database. If you make such a request you will be withdrawing from the competition as it will not be possible to contact you in the event that you are the winner. You will not be entitled to any refund of any entry if you withdraw from the competition.
9. General
9.1 The Promoter reserves the right to amend these terms and conditions from time to time.
9.2 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Main Competition or the Luxury Two Night Escape Draw and any future competitions.
9.3 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so. In which circumstances the Luxury Two Night Escape Draw will be cancelled and no prizes will be given.
9.4 These terms and conditions shall be governed by New Zealand law, and the parties submit to the exclusive jurisdiction of the courts of New Zealand.
9.5 If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these terms and conditions and the remaining clauses shall survive and remain in full force and effect.
9.6 You should print a copy of these terms and conditions and keep them for your records.
